Talk Program on Rule of law |

"The rule of law is better than that of any individual."Youth for
Change, Nepal in support of Pokhara Chamber of Commerce and Industry (PCCI)
organized a talk program on Rule of law on 13th Baisakh,2062 ( 26th April,
2005). The Chief Guest Rajendra Kumar Lalchan, President, PCCI and guest Mankaji
Makaju , General Secretary PCCI highly appreciated the initiatives taken by
Youth for Change, Nepal and promised to provide any kind of possible support
from Pokhara Chamber of Commerce and Industry. Speakers/Pundits Mr Fredrick
G. Yeager, Chief of Party, ARD.Inc. Rule of law project and Mr Bishnu Kusal
Bhujel, Vice president, Nepal Bar Association explained various aspects of
Rule of law. Altogether 70 young people from different colleges and professions
participated on the program.

The
Rule of Law |
The essential
characteristic of the rule of law are:
i. The supremacy of law, which means that all persons (individuals and government)
are subject to law.
ii. A concept of justice which emphasizes interpersonal adjudication, law
based on standards and the importance of procedures.
iii. Restrictions on the exercise of discretionary power.
iv. The doctrine of judicial precedent.
v. The common law methodology.
vi. Legislation should be prospective and not retrospective.
vii. An independent judiciary.
viii. The exercise by Parliament of the legislative power and restrictions
on exercise of legislative power by the executive.
ix. An underlying moral basis for all law. |
